See, this is why im kind of depressed lately. The fact that this guy straight up hit me and nothing is going to happen to him just has me angry.

Do I count as a pedestrian though if I am working ?

you certainly do, i also bet you probably had a vest on with reflection tape all over it?

i'm telling you right now, make a few calls to lawyers (make sure they are free unless you win - then they'll fight really hard) tell them your story, tell them you're in a lot of pain, get a doctors note....

i hope you got the guys info that hit you?

I am not a lawyer - I don't think we have any here? Workman's comp usually covers these things. Step 1 - go to doctor, Step 2 - go to lawyer, Step 3 - report to WSIB

Even if you don't have cash a whole bunch of lawyers do these things on spec...

all of his info was taken yah. I also just got a note in the mail from his insurance company.

Yes I had all my safety gear in use. Vest and rope for the carts.

My Dad works for some lawyers. Im going to ask him to talk with them and see what they say.

yah I went to my DR as I had to to fill out all the WSIB stuff. Took like 4 days off and they are going to be paying me for that lost time (hopefully).

I did 2 years of military law (in the military - obviously lol) and we practiced some civilian stuff, not a lot of law translates from the military to civi life, but i think this is one of these cases.

i'm not sure what retarded cop showed up on the scene, but he should have been charged. i have no idea how you miss someone pushing carts with all the proper reflective gear on.

cop said because its private property and he was only going 25-30 km/h he couldn't be charged with any thing.

As for the DR.s Im trying to get into see him today. The office is out at lunch atm though. Gotta phone back in like 30.

Odd, you'd think a cop would know. However, a lawyer will 100% know.

There is a clause called "notwithstanding clause" which may give you the right to sue the owner of the priviate property, and in return, the owner of the property can then turn around and sue the driver of the car.

Best advice is to definitely call a lawyer - it doesn't sound like you're trying to make it big here, rather it's about being treated fairly.

You were working safely

You were hit by a driver who made a mistake


those are the 2 parties at fault, and I think as both Steve & Mike have said, that you will be able to find a lawyer willing to take the case on w/a %pay of winnings.

Ive been to my dr a few times. Xrays im getting on friday tony.

Its likely just a really really really bad bruise thats lasted 2 weeks now (all the bruising is still there 2 weeks later!) Dr thinks there is still pain because of blood build up from the contusion or something.

Thank goodness I can walk OK for the most part.

Although I'm not a lawyer I took a number of years of schooing in university. I can tell you this much: the cop is right, the driver most likely would not be charged with anything under criminal law as there isn't really a law that fits this situation. It can't be considered reckless driving as there is a speed element that is required to classify as reckless.

This is a case that is more suited towards the civil courts. The likely charge you would put forward is assault & battery or some kind of vehicular assault (they keep changing the name on it so Im not sure the term right now). Definitely lawyer up, you'll clean his clock in a civil suit (so long as he has money otherwise you're SOL!)

Pretty sure he has money...he hit me with a 5 series BMW!

I count myself so very fortunate that I didn't break any bones or suffer some sort of skull fracture (SOMEHOW I actually landed on my feet after actually being launched up in the air a bit and back 3-4 metres lol). The fact that he isn't being charged criminally though is really whats making me seek out this law firm. It's not about the money or anything like that. It's about making this guy face some sort of repercussion for hitting me in the parking lot.
