I don't want to start a trend with this...I asked openly for a 2012 5th for those three picks and Frank chimed in and said he's interested. He does own his 2013 4th and I'm basically considering it as my pick until he sends a 2012 5th.

Btw, i'd like to hear why this deal should not be allowed IF you (and others) are allowed to trade picks they don't have.
It's the same here, only Shoa takes the care to specify what would happen in case he can't eventually provide such pick.. so, if anything, this deal is a step better than yours.

As I told Frank, he's good for getting me a pick and he's got the other pick in his possession if he doesn't cash in. It's obviously more beneficial to him to get me a 2012 5th rather than having to surrender a 4th for the following year.
