AGAIN I REPEAT: IF THE CC VOTED TO TAKE AWAY PHI 1st 2011 FROM FRANK THERE WOULD BE NO ISSUE.
The CC wanted a discussion but Mike stepped in and said no discussion. My way or the highway.
That is the issue I am fighting here. This can't keep happening. Every time an admin pulls rank, shit hits the fan. And with good reason.
But if the CBA already states a penalty for the infraction, why does it need to be voted on?
The vote would have been to give Frank a couple of days to find another 1st as the CBA does not say when Frank needs to pay the penalty. IMO he technically should have till draft day to find the pick to pay. Not only that but the CC could have voted on which picks in the 1st round classify as penalties i.e. #7 to #15
I think it's perfectly fair and assumed that the penalty should be paid immediately. I remember when Mash had to pay his penalty for not meeting GP..he paid it right away..not the day of the draft. I love you Shiv, but you are nitpicking.

If you understood the workings of the CC you wouldnt say that. This issue to me is not about Frank. It is about Mike/the Admins circumventing the CC to pass their ruling without a CC vote. If the CC voted to take away 2011 PHI 1st from Frank there would be no issue.

Why does the CC vote on something that is in the rulebook? Removing the 1st round pick as a punishment.
Okay, it doesn't say when or what pick. But I don't understand why it wouldn't be now and the 1st he owns.
Not sure why the "what pick" comes into this. He had 1 1st. It was taken away. The end. If he didn't have a 1st, as was brought up, then he'd have the chance to get that 1st to lose.
But, clearly Shiv is not changing his stance on this. I don't really care. This has been decided and won't change, so really the only reason to continue this is because you feel the CC should have voted on this, which I definitely disagree with. Not sure why the CC would vote on the punishment that is in the rules. Even though there is a grey area in the rules, the Admin made the decision. What's wrong with that?
We've all felt the CC gets ignored at times.
Blahhhh whateverrrrrr. I don't even care about this issue. The board is slow tonight and I'm sitting in a hotel room in Regina. Woooooo.

I still don't see how this is pulling rank and why this needed to be voted on.
Is Kareem not around? This just seems like an issue he'd be going all out on.

This is 100% correct and exactly the situation here. We all get that Shiv's pissed off and feels it was too harsh a punishment.. but it is what it is. There is 0 "rank" being pulled.

From what I am reading it seems the penalty is said to be paid immediately so there it is, secondly if it is an issue with the cc shiv I personally think you should be doing this in private because dont speak for me because i dont agree with a single thing you said.

It's great that a bunch of people who weren't there are reading the rule the way they want, however I was there when it was being written, and it was intended to read like the NHL's rule (which is: fine by round (1st, 2nd 3rd) year (2011), due before upcoming draft, team can trade for a pick and designate it the pick to be taken for fine payment). If the powers that be are interpreting it differently that means there needs to be a *bleeping* discussion, not moves being made because you can.

That's disagreed with. He's not just saying its too harsh a punishment, Shiv is saying decisions are being made by 1 person acting like an authority, which is not how this works. Being on the same side that is making moves doesn't make it 100% right... in fact it seems to be 2 for and 4 against + (1 quiet) but the 2 made moves....
