Edmonton has cap room and Khabi's driving issue and back problem is what I mean by up in the air

Take a look this is from July 7, 2010
Court case: Nikolai Khabibulin appeared in an Arizona court today. It was the much anticipated start for his speeding and extreme DUI charges. However, his court date has been postponed to an as of yet unspecified date apparently due to a backlog of other cases. If found guilty, he could face a minimum 30 day vacation at the grey bar hotel.

"Rehabibulin": From David Staples at the Cult of Hockey, Khabibulin has been on activity restrictions in May and has not yet recovered from his season-ending back surgery.

With the apparent delay in his recovery along with his court date, it's likely that these two factors will impact his ability to play this season.
