While it was an intentional spear/slash, it wasn't intentional to the face. If you watch the replay slowly his back hand hits the glass and projects his stick upwards. Still gotta give a hefty suspension for it tho.

You could see the instant regret from Nyquist after it happened but you just can't attempt to thrust the blade of your stick right into another player's face.

More and more, the act isn't punished as much as it's about how serious the resulting injury is. Spurgeon wasn't seriously hurt but the act can't be condoned. The refs dropped the ball in not tossing him from the game right away. I don't know how they could call it a high stick while not see the actual act. It wasn't the common accidental flip of the stick up towards the face. Gus speared him in the face.
