If NJ doesn't refile and the NHLPA doesn't grieve, Kovy will be a UFA. If the PA grieves, his future is up in the air pending resolution.

ps-> there is no named arbitrator yet -> does not exist.

Also note, this is not a negotiation between Kovalchuk & the NJD or NJD & the NHL, this is a union work site which is governed by a CBA, so all proceeding events with this go through the NHLPA & the NHL (management & union, classic mistake is to focus on the individual or the specific site employer).

how the hell can they file a grievance...this deal is full retard. I would 100% love it if it was my team but I would still realize that its a joke of a contract.

Because their is precedence for such a deal, and technically this deal does not break any rules in the CBA.

They are a union and they should back Kovy... he's no different from Lou, Pronger, Hossa, etc.... he contributes huge dues and this is why.

i get that but imo his is the worst yet and its spiralling big time, time for the league to step in. I understand that they are breaking no actual rule otherwise every team wouldnt have one of these contracts out there. I have no argument for them not to file a grievance other than the fact that i personally think these kind of deals are getting rediculous.

ye, but the union will simply say there is no difference, and they are right.

when hossa signed his it was the first of the kinda

then pronger and lou signed ones that take them past retirement age

Then Kovy pushes it that next nudge with ultra low final years (not 1M, but 750k and 550k)... however contract law is tricky, especially international, union worksite, dealing with an international...add in NHLPA being confused within itself...but NJD's right hand man, their cap guy, actually wrote large portions of the CBA (worked for NHL at the time).
